I feel it is first degree. This was definitely premeditated murder. Even if by a few minutes thats all it takes to decide this. I feel even as the man begged for him dead mom to save him, he got off on his suffering. Spur of the moment or not. Once he decided to stay on the guy's neck even after he was dead just goes to show he had all the intention of killing him.
