Going into court isn't as easy as it seems...
First off, the responsibility of its care falls on your shoulders, so it would be just a mistrial.
Second, even IF you could get it into court, you'd need a lawyer, which aren't cheap, and the big part, most of them could last for months or even years, but I doubt something like this would work.
My suggestion, check the warranty, maybe you could get a replacement somehow...
