In old comics Batman used to kill before it didn´t get highlighted that hard and I guess the creators shook it off. In the Killing Joke which later got Kanon for the Joker history it was actually planned by the creators that Batman killed Joker in the end but when it got Kanon the creators just said that Joker lives after the comic. There are tons of interviews with the DC staff behind Batman that mentioned the killing of Batman before. I guess it was never really planned that Batman should not kill just that he doesn´t use guns due to his past.
