Read the screenshot. It's required for you to accept the ToS for usage of site. By using it, you're acknowledging the acceptance of this, therefore binding you to following the ToS or risk banning. If you don't agree, why are you here? Your logic makes no sense. Also, as previously stated, as far as I'm aware, the only person with banning powers is Sephiroth.

Except by logging in, you are agreeing. Every website has a ToS you agree to in this way; Facebook, Twitter, Youtube, Pornhub... there is no "I accept" button, and registration doesn't come with a page long TOS before you sign up. You are using their product or service, by doing so, you agree to their rules. Just because you don't agree, doesn't mean you're able to do whatever you like and still use their service. Don't agree, don't use. It's simple.

Sephiroth does own a company, technically, but you don't have to own a company to have to follow a ToS agreement for using ones property.
