Okay the judge was oddly nice to the prosecution. And he knew he had grounds to not accept the evidence and still did even though he shouldn't have. I think he's doing this to try and make it seem like he's being lenient with them. I think regardless of what the jury decides he's going to do a directed verdict at the end if they rule guilty. If you already know the results then you don't care what Is done and what is not for motions and stuff. I think Kyle's walking away from this. He might get the one misdemeanor charge and that's it.

He's probably being nice because they're probably purposely fucking up to try for a mistrial. The prosecution is so bad you have media outlets going on smear campaigns saying the judge is bias. This is their last ditch effort
