Reasonable Age Of Consent

In my opinion, 16 is around the age where it should be open to interpretation. If they can show that they know what they are doing, by taking a test, answering a few questions, then I think that prosecution for statutory rape should be out of the question, as they are now aware of the risks and what they are doing. In my opinion, if they do not fully understand what they are getting into, regardless of age, and the individual takes advantage of that, then it is rape. It's the same as taking advantage of someone's mental immaturity/incapability for personal gain. TL;DR 16 and they need to be aware.

thats dumb honestly the boy gets charged when it may or may not have been a mutual thing. i feel like 15-16 should be the reasonable age as well because by then you already know whats right and whats wrong

I think we wouldn't need age of consent laws if young people were properly educated. But religion prevents that as well as unfettered access to birth control.

As a prosecution major, let me quote this from my mentor "In rape cases, men are guilty until proven innocent in the eyes of the jury."

@Loli It's not just about education. Physically, if they haven't yet finished their "puberty stage" and they have sex, it could trigger unwanted hormones and could actually stunt growth AND deteriorates mental health by causing depression and other mental issues, such as actual mental development.

You notice too that if a guy and girl get drunk and have sex it's still seen as the guy taking advantage. Because in the eyes of society girls are never responsible for their actions when drunk but guys are.

@Loli well, it depends. If both are drunk and a sexual encounter happens, legally, neither should be held reliable. Theortically speaking, at the way the law is written, if a drunk driver hits another drunk driver, there aren't many ways to prove what started what and there needs to be a victim to start a trial. What if they're both the assailant and the victims? It turns into a "victimless" crime. Of course the media doesn't care though, men are evil rapists :) EDIT: THEY BOTH CAN BE CHARGED WITH DUI, BUT THE ACCIDENT THAT OCCURS WITH IT WILL MOST LIKELY BECOME VOID EDIT EDIT: UNLESS ONE OF THEM HAS IT RECORDED OR HONES UP TO IT
