In prison most guys get raped anyway. But also, if a man is accused of rape and he is innocent but was sent to prison on false terms, then why would you rape him anyway? If you rape a non-rapist, what then? Same with a thief. If the man didn't steal yet was accused of stealing, why cut off the hand of a man who didn't steal? I don't understand some laws like that.

"most guys" is not really factual but prison rape is definitely a problem. The statistics are kind of blurry..

Also 1 in 5 inmates experience "some form" of pressured or coerced sexual conduct or rape while incarcerated. In another study 70%-80% of the surveyed inmates sighted prison staff as the aggressors.. which is really fucked up. There's always a slim chance for innocents being imprisoned.. nothing you can really do about it. As for Germany, just accusing someone does nothing. You have to have actual evidence. Same thing when you accuse someone of stalking or sexual assault of any other form. It's good for protecting people from getting sentenced when innocent but also means that rape victims have to face everything within the first 24hours of being assaulted to collect possible evidence and such... there's really no perfect way of dealing with it as of now.
